Restrictions on event locations (e.g., events abroad, touristic locations, mountain or beach locations during winter/summer season, etc)

The selection of location and venue for the meeting shall be reasonable in relation to the purpose of the meeting. The following is a non-exhaustive list of locations that shall be avoided according to the Ethical Rules for the Pharmaceutical Industry:

  • winter sport locations during ski season;
  • locations hosting major international events (e.g., sport events) at the same time of the event.

Interactions with HCPs is not regulated in Swedish law. General rules on anti-bribery could apply which are regulated in the Swedish Penal Code (Sw. Brottsbalken).

The Swedish Anti-Corruption Institute (Sw: Institutet Mot Mutor “IMM”), a non-profit organization, has issued the “Code to prevent Corruption in Business”, a self-regulation code which can be viewed as a supplement to Swedish legislation on bribery. The code applies to all businesses and is not specific to the pharmaceutical industry.

Industry code(s) of conduct

Members of the trade association Läkemedelsindustriföreningen (Lif) are bound by the Ethical Rules for the Pharmaceutical Industry.

Restrictions or requirements regarding accommodation provided to HCPs (e.g. five star hotels, maximum number of nights, minimum duration of events, etc.) Under the Ethical Rules for the Pharmaceutical Industry, it is prohibited to provide accommodation to HCPs practicing in Sweden attending events (e.g., meetings and congresses etc.).  Accommodation may be provided to HCPs engaged as consultants, if required for performance of the consultancy assignment.

Restrictions on air travel (e.g. economy class only; minimum flight duration for business class) Under the Ethical Rules for the Pharmaceutical Industry, travel expenses may not be paid for HCPs attending events (meetings and congresses etc.). For HCPs engaged as consultants, air travel, economy class should be selected. Duly justified exceptions may be made for travels (> 6h) outside of Europe.

Other restrictions regarding travel Travel should be arranged so that arrival and departure is as close as possible to the opening and closing of the consultancy assignment at the event.

Limitation on providing meals (e.g. only refreshment for events lasting for half a day or more) Under the Ethical Rules for the Pharmaceutical Industry, a moderate meal in connection with the meeting may be provided. No other more specific rules apply.

Under the Ethical Rules for the Pharmaceutical Industry, the following limits apply:

  • SEK300 (incl. VAT) maximum for lunch;
  • SEK850 (incl. VAT) maximum for dinner.
Restrictions on where meals can be provided? (e.g. no Michelin-starred restaurant) Under the Ethical Rules for the Pharmaceutical Industry, the selection of location and venue for an event shall be reasonable in relation to the purpose of the meeting. Places known for their exclusivity shall be avoided. In general, principle of moderation applies.
Other restriction (e.g. no alcohol may be offered) Under the Ethical Rules for the Pharmaceutical Industry, only wine and beer in limited quantities may be offered during meals. Spirits are never allowed. Non-alcoholic alternatives must always be available.

Specific rules on engaging or interacting with HCPs in regard of medical devices The Swedish Association of Local Authorities and Regions (SALAR) and, among others, the trade association Swedish Medtech have agreed on common regulations for how employees and managers in healthcare and industry should collaborate and interact with each other, the Agreement on Collaboration Regulations. The agreement contains rules on interactions with HCPs applicable to members of Swedish Medtech.
