The Procurement Act received Royal Assent on 26 October 2023, marking a significant milestone in the government’s procurement reforms. The Act is expected to come into force on 1 October 2024 and all procurements started after that date will have to comply with the new rules. Public bodies and their suppliers have to understand these new rules and the various steps required to run a successful procurement.

This tool sets out 18 steps required to run a compliant procurement using the Procurement Act’s new competitive flexible procedure. From planning and preparation right through to award, each step covers the key information and links to legislation to help you navigate this regulatory change.

The Procurement Act 2023 is expected to come into force on 1 October 2024 and that procurements commenced prior to this date will be subject to the Public Contracts Regulations 2015, which will continue to apply throughout the entire life of such contracts.

What is the Competitive Flexible Procedure?

The competitive flexible procedure replaces most of the procurement procedures that currently exist under the Public Contracts Regulations 2015, other than the open procedure. It provides greater flexibility for contracting authorities to design how individual procurements will operate in practice.

What does this tool not cover?

This tool focuses solely on the Competitive Flexible Procedure. It does not, for example, cover the special regime or concession contracts.
